Recent research in ethics education shows a potentially problematic variation in content, curricular materials, and instruction. While ethics instruction is now widespread, studies have identified significant variation in both the goals and methods of ethics education, leaving researchers to conclude that many approaches may be inappropriately paired with goals that are unachievable. This paper speaks to these concerns by demonstrating the importance of aligning classroom-based assessments to clear ethical learning objectives in order to help students and instructors track their progress (...) toward meeting those objectives. Two studies at two different universities demonstrate the usefulness of classroom-based, formative assessments for improving the quality of students’ case responses in computational modeling and research ethics. This book surveys a wide range of cases, and considers how these achievements were possible and how adversity helped shape the ideas that emerged.

Sustainable and ethical leadership in the financial industry expand in importance since the financial crisis of 2007–2009. This research examined the level of sustainable and ethical leadership of leaders in mortgage loan originator (MLO) organizations, as perceived by loan originators. The Perceived Leadership Survey (PLIS) developed by Craig and Gustafson (Leadersh Q 9(2):127–145, 1998) and the Sustainable Leadership Questionnaire (SLQ) developed by McCann and Holt (Int J Sustain Strat Manage 2(2):204–210, 2011) were utilized for this research. The survey results yielded (...) high levels of both ethical and sustainable leadership. Employees also felt their leadership was encouraging ethical and sustainable behavior. However, correlations between the PLIS and SLQ did not prove to be dependent or closely correlated. (shrink)

Decision theory seems to offer a very attractive normative framework for individual and social choice under uncertainty. The decisionmaker should think of her choice situation, at any given moment, in terms of a set of possible outcomes, that is, specifications of the possible consequences of choice, described in light of the decisionmaker's goals; a set of possible actions; and a "state set" consisting of possible prior "states of the world." It is this framework for choice which provides the foundation for (...) expected utility theory, as demonstrated in the work of Leonard Savage. Problems arise, however, when the decisionmaker is boundedly rational: when the mental process of thinking about outcomes, actions, and states is itself expensive and time consuming. In the case of the unboundedly rational decisionmaker, decision theory enjoins her to employ maximally specific outcomes; to consider all possible actions; and to use a set of mutually exclusive and collective exhaustive states, each of which is sufficiently finely specified so that each action, together with each state, yields one and only one maximally specific outcome. In the case of the boundedly rational decisionmaker, this procedure is either infeasible or, if feasible, irrational. This paper presents the problem of bounded rationality. It surveys possible solutions, none of which are found to be attractive. And it concludes by discussing the difficulties that the problem of bounded rationality poses for the welfarist program for legal scholarship presented by Louis Kaplow and Steven Shavell in their book, Fairness versus Welfare. This article stages a new encounter between rhetoric and the philosophy of Karl Marx. We argue that the configuration of two major tropes in Marx’s 1852 pamphlet The Eighteenth Brumaire of Louis Bonaparte renders explicit the operative but implicit logics of Marxian historical materialism. Our reading therefore makes available a novel and untimely dimension of Marx’s conceptual labor where we least expect to find it: in a text that has been largely, but not exclusively, understood as a history of (...) counterrevolution that was meant to intervene within its own context in particular ways. In this article, I discuss prospects for democracy in the Middle East. I argue, first, that some democratic experiments—for instance, Egypt under Mohammed Morsi—are not in keeping with etymological and historical meanings of democracy; and second, that efforts to promote democracy, especially as exemplified in U.N. documents emphasizing universal rights grounded in Western traditions, are possibly totalitarian and also colonialist and hence counter to democratic ideals insofar as they impart one set of values as the only morally acceptable ones. A (...) respectful dialogue in which people from both regions strive to understand conditions giving rise to certain social practices would be more productive than morally superior attitudes, and help all to see areas where their respective cultures could be improved. I conclude by discussing concepts of democratic and pragmatic faith articulated by John Dewey and William James, arguing that democracy will continue to flounder in the Middle East so long as the basic trust implied in these concepts is lacking; and how Westerners might consider this a cautionary tale regarding social attitudes and public policies contrary to democratic life in their own countries. Judith Butler has built her theory of interpellation through critical engagement with the work of Louis Althusser. For Butler, interpellation explains how the subject emerges in and through language, and her critique of Althusser is meant to open up psychic and discursive space for resisting status quo interpellations and the dominant ideology. In this essay, I argue that Butler’s account of interpellation suffers from two problems: first, she misreads Althusser; second (and more importantly), her account is isolating and politically (...) demotivating. I then show that rereading Althusser provides us both with a criticism (albeit avant la lettre) of Butler’s position, and a new account of the resources at our disposal for resisting (and even opposing) the dominant ideology. According to Louis Sass, Josef Parnas, and Dan Zahavi (2011), the account of current developments in "phenomenological clinical neuroscience" offered by Aaron Mishara (2007) is "not only confusing but highly inaccurate." Their critique is harsh, but I can find nothing to disagree with. Mishara's distinction between "neo-phenomenology" and "existential phenomenology" does not apply to current work in the field; I do not recognize the two camps he describes. Neither do I find it helpful to distinguish two separate historical traditions (...) in phenomenological psychiatry. James Martel’s The Misinterpellated Subject attempts to productively expand upon Althusser’s theory of interpellation through the development of a concept Martel calls “misinterpellation.” Martel puts this concept to use to develop a critical mode of reading as part of an explicitly political project, which Martel links with anarchism. The book is lofty in its ambitions, but the most interesting aspects of Martel’s book are buried beneath less compelling passages of literary criticism.

The development of the aquaculture industry in Canada has triggered a conflict of a scope never seen before. As stated in Young and Matthews’ The Aquaculture Controversy, this debate has “mushroomed over the past several decades to become one of the most bitter and stubborn face-offs over industrial development ever witnessed in Canada” (Young and Matthews in The aquaculture controversy in Canada. Activism, policy and contested science. UBC Press, Vancouver, p 3, 2010). It opposes a wide variety of (...) actors: from industrial investors, scientists, politicians and environmentalists to Native associations and communities, citizens groups and local stakeholders. The opposition is fierce between those in favor of a flourishing and modern aquaculture of industrial nature and those who fear the dreadful consequences of such an industry. In particular, the possible implementation of biotechnology innovations, such as a genetically modified salmon, has made this debate coextensive with the GMO debate, thus multiplying the opposition’s spectrum of arguments against the industry. Throughout the debate, Canadian environmental NGOs like the Suzuki Foundation and Greenpeace Canada have assumed leadership over the opposition to aquaculture development with certain success. Their participation in the debate features numerous ethical concerns related to environmental health, a respect for wilderness and local human communities. Such a position can be associated overall with a form of ecocentric ethics or concern. Nevertheless, a careful examination of the technical solutions proposed by these NGOs reveals their embeddedness in biocentrism. Through the example taken from the Canadian debate on aquaculture development, this paper aims to highlight the conceptual difficulty of enacting ecocentric ethical positions beyond formal arguments. Because ecocentrism implies a true paradigm shift, not only in mentality, but also in the way we conceive our technical interventions in nature, biocentrism remains an important practical method to enact ethical positions related to environmental concerns in public debates. ABSTRACT This essay argues for the emergence of a cultural and epistemological divide between amateur savants and members of the Royal Academy of the Sciences in late Old Regime and revolutionary France and suggests that the amateur ideal rose in significance even as intellectual activity came to be increasingly centralized in the postrevolutionary era. At the crux of the tensions between the amateur ideal and the professionalizing reality in the immediate postrevolutionary period stood Aubin-Louis Millin and his journal, the (...) Magasin Encyclopédique. The essay examines, in particular, the revival in the pages of the Magasin Encyclopédique of interest in Nicolas-Claude Fabri de Peiresc, the seventeenth-century icon of an amateur ideal in which investigations in the natural sciences and scholarship were private, decentralized, often provincial activities. Although the sciences in the revolutionary and Napoleonic eras were often perceived as forward looking and dismissive of the past, this essay finds that a sentimental and nostalgic attachment to the past—to a myth of Peiresc—continued to play an important role in the identity of postrevolutionary men of letters. This is a short introduction to a book symposium on Paul Gowder's recent book, _The Rule of Law in thee Real World_ (Cambridge University Press, 2016). The book symposium will appear in the St. Luis University Law Journal, 62 St. Louis U. L.J., -- (2018), with commentaries on Gowder's book by colleen Murphy, Robin West, Chad Flanders, and Matthew Lister, along with replies by Paul Gowder.

The border is an area where the rule of law has often found difficulty taking root, existing as law-free zones characterized by largely unbounded legal and administrative discretion. In his important new book, The Rule of Law in the Real World, Paul Gowder deftly combines historical examples, formal models, legal analysis, and philosophical theory to provide a novel and compelling account of the rule of law. In this paper I consider whether the account Gowder offers can provide the tools needed (...) to bring the border under the rule of law. I argue that on Gowder’s account, there are two ways in which we might try to extend the rule of law to the border.The first is to look at concrete connections that current citizens or members of the political community have with non-citizens. Just as the interests of current citizens give them strong reasons to coordinate to establish the rule of law in their own community, so may the interests of current members in connections with nonmembers give them reason to work to extend the rule of law to the border. These interests can include family ties, other forms of personal relationships, offers of employment, intellectual connections, and others. Some of these connections already serve to give greater legal protections, including protections from arbitrary decision-making, to some non-citizens, and the general trend, I argue, can and should be further strengthened The second method for extending the rule of law to the border involves appealing to certain universal norms so as to build a sense of community that stretches beyond borders. While these norms are not as robust or well established as domestic law, and therefore are unlikely to extend all of the protections of the rule of law to all people at the border, they can, I argues, be a basis for working against the worst arbitrary actions by border officials. I conclude by considering the vexed dispute about providing “amnesty” for unauthorized immigrants in the United States and other countries. I argues that Gowder’s account of the amnesty provided to supporters of the oligarchic coups in ancient Athens provides a model for thinking about when and how amnesties for unauthorized migrants can be done without offending the rule of law, thereby making them more palatable to current citizens. This paper proposes a novel use of tax policy to address one of the most pressing issues arising from economic globalization and international migration, that of “brain drain” – in particular, the migration of certain skilled and highly trained or educated professionals from less and least developed countries to wealthy “western” countries. This problem is perhaps most pressing in relation to doctors, nurses, and other medical professionals, but exists also for teachers, lawyers, economists, engineers, and other highly skilled or trained (...) professionals. While there have been other proposals in the past to use tax policy to address brain drain (most famously versions of the so-called “Bhagwati Tax”, a form of exit tax), in this paper I provide an account of and justification for using tax credits, modeled loosely on the foreign tax credits U.S. citizens receive in certain situations for taxes paid in other countries. My proposal avoids several of the pitfalls of other methods of using tax policy to ameliorate the harms of brain drain, as it does not subject people from the developing world to potentially onerous double taxation, and does not depend on sophisticated tax collection capabilities within developing countries, capabilities which are often lacking. Additionally, my proposal also leads to fewer morally problematic restrictions on the liberty of citizens of less and least developed countries than do non-taxed based alternative proposals, such as temporary bans on migration. While the proposal cannot hope to completely solve the problems that arise in relation to brain drain – no approach can do this – it does provide a straightforward way to ameliorate the problems that arise from it without placing significant financial or liberty burdens on already less advantaged people from the developing world. -/- (This paper may be downloaded for free from the link to my SSRN page below). Groove—defined as the pleasurable urge to move to a rhythm—depends on a fine-tuned interplay between predictability arising from repetitive rhythmic patterns, and surprise arising from rhythmic deviations, for example in the form of syncopation. The perfect balance between predictability and surprise is commonly found in rhythmic patterns with a moderate level of rhythmic complexity and represents the sweet spot of the groove experience. In contrast, rhythms with low or high complexity are usually associated with a weaker experience of groove (...) because they are too boring to be engaging or too complex to be interpreted, respectively. Consequently, the relationship between rhythmic complexity and groove experience can be described by an inverted U-shaped function. We interpret this inverted U shape in light of the theory of predictive processing and provide perspectives on how rhythmic complexity and groove can help us to understand the underlying neural mechanisms linking temporal predictions, movement, and reward. A better understanding of these mechanisms can guide future approaches to improve treatments for patients with motor impairments, such as Parkinson’s disease, and to investigate prosocial aspects of interpersonal interactions that feature music, such as dancing. Schmaltz’s excellent book tells a story unfamiliar to most English speaking historians of philosophy. The historical aspect of the story centers on Louis XIV’s 1671 decree opposing anti-Aristotelianism. The decree spoke to the growing popularity of Descartes’s philosophy during the twenty years after his death. Schmaltz examines two figures central to the dissemination and reinterpretation of Descartes’ philosophy at this time: Robert Desgabets and Pierre-Sylvain Regis. The Benedictine Desgabets played an important role in defending Descartes’s controversial views on the (...) eucharist, arguably the catalyst for the 1671 decree. His disciple, Regis, elaborated and propagated Desgabets’s brand of Cartesianism in the face of the political firestorm generated by the decree. (shrink)

Postcolonial science studies entails ostensibly contradictory critical and empirical commitments. Science studies scholars influenced by Bruno Latour and Isabelle Stengers embrace forms of realist, radical empiricism, while postcolonial studies scholars influenced by Jacques Derrida trace the limits of the knowable. This essay takes their common use of the term cosmopolitics as an unexpected point of departure for reconciling Derrida’s program with Stengers’s and Latour’s. I read Derrida’s critique of hospitality and Stengers’s and Latour’s ontological politics as necessary complements for conceiving (...) a care-oriented subalternist cosmopolitics, a process of composing common worlds that remains attentive to the limits of representation. Suppose we consider knowledge to be valuable because of the role known propositions play in practical reasoning. This, I argue, does not provide a reason to think that knowledge is valuable in itself. Rather, it provides a reason to think that true belief is valuable from one standpoint, and that justified belief is valuable from another standpoint, and similarly for other epistemic concepts. The value of the concept of knowledge is that it provides an economical way of talking about many (...) epistemic concepts that are valuable in itself from one standpoint or another. In this way knowledge is like a Swiss Army Knife; a Swiss Army Knife is not useful as such on any occasion, but it provides an efficient way of carrying around different tools that are useful in themselves on different occasions. On the one hand, Hume accepts the view -- which he attributes primarily to Stoicism -- that there exists a determinate best and happiest life for human beings, a way of life led by a figure whom Hume calls "the true philosopher." On the other hand, Hume accepts that view -- which he attributes to Scepticism -- that there exists a vast plurality of good and happy lives, each potentially equally choiceworthy. In this paper, I reconcile Hume's apparently conflicting commitments: (...) I argue that Hume's "Sceptical" pluralism about the character of the happiest life need not conflict with his "Stoic" advocacy of the supreme happiness of the true philosopher, given Hume's flexible understanding of how one might live as a true philosopher. In Nicomachean Ethics X.7–8, Aristotle defends a striking view about the good for human beings. According to Aristotle, the single happiest way of life is organized around philosophical contemplation. According to the narrowness worry, however, Aristotle's contemplative ideal is unduly Procrustean, restrictive, inflexible, and oblivious of human diversity. In this paper, I argue that Aristotle has resources for responding to the narrowness worry, and that his contemplative ideal can take due account of human diversity.

In Plato’s Symposium, the mysterious Apollodorus recounts to an unnamed comrade, and to us, Aristodemus’ story of just what happened at Agathon’s drinking party. Since Apollodorus did not attend the party, however, it is unclear what relevance he could have to our understanding of Socrates’ speech, or to the Alcibiadean “satyr and silenic drama” (222d) that follows. The strangeness of Apollodorus is accentuated by his recession into the background after only two Stephanus pages. What difference—if any—does Apollodorus make to the (...) Symposium? Does his inclusion call the dramatic and philosophical unity of the work into question? I argue that despite initial appearances, Plato has important philosophical reasons for including Apollodorus as a character. Far from being an odd appendage to an otherwise complete narrative, the figure of Apollodorus is useful for our understanding of Socrates’s conception of eros later in the work. (shrink)

The impressive variation amongst biological individuals generates many complexities in addressing the simple-sounding question what is a biological individual? A distinction between evolutionary and physiological individuals is useful in thinking about biological individuals, as is attention to the kinds of groups, such as superorganisms and species, that have sometimes been thought of as biological individuals. More fully understanding the conceptual space that biological individuals occupy also involves considering a range of other concepts, such as life, reproduction, and agency. There has (...) been a focus in some recent discussions by both philosophers and biologists on how evolutionary individuals are created and regulated, as well as continuing work on the evolution of individuality. Its systematic role in human experience has not been analyzed and interpreted from top to bottom. In this book, the author attempts to provide such an analysis in the philosophical traditions of hermeneutics, phenomenology, analytic philosophy of language, and psychoanalysis. applying his interpretation of empathy to the philosophical issues of intentionality, the emotions, and the checkered transformations of empathy itself. Beginning with the philosophical infrastructure of the hermeneutics of empathy, this work thoroughly explains the complex architecture of empathy, tracing it downward through the levels of authentic human interrelations, empathy with unexpressed emotions, the empathic penetrability of cognitively impenetrable affect, the first-ever intentional analysis of both the empathizer and the “empathasand” in interrelation, and the hermeneutic infrastructure. The consequences of empathy are exposed in the context of the emotions, cognitive impenetrability, empathy and altruism, and the intentionality of empathy as accessed through language and story telling. Drawing on the multi-method approach of hermeneutics, phenomenology, and story telling, this work demonstrates that empathy forms the foundation for community in ways not clearly appreciated in the on-going debate. In a bootstrap operation that is guided by Heidegger’s call for a “special hermeneutic of empathy,” this work achieves a delicate balancing act of unpacking the rich intellectual traditions from which empathy - the phenomenon itself, not the concept - emerged historically. When we look at his own estimation (...) of the value of his first book, however, we see that he maintained something of a love-hate relationship to it. In the second edition, published in 1886, Nietzsche included a prefatory “Attempt at a Self-Criticism,” in which he castigates the style of his first literary effort:[T]oday I find it an impossible book: I consider it badly written, ponderous, embarrassing, image-mad and image-confused, sentimental, in places saccharine to the point of effeminacy, uneven in tempo, without the will to logical cleanliness... disdainful of proof, mistrustful even of the “propriety” of proof... an arrogant and rhapsodic book.... 1Yet Nietzsche was convinced that the book, despite its stylistic flaws, did indeed have its merits. I describe Stump’s account of the will and describe its connection to her explanation of divine hiddenness. Specifically, I show that her account of the knowledge of persons cannot solve the problem (...) of divine hiddenness.
